A homeowner in Manchester Township, York County was surprised when his insurance company denied his claim after a hail storm last year left behind significant damage.
Joseph Nolte had an Erie Insurance Group adjuster check his roof for possible hail damage. He has been an Erie customer for 38 years and trusted their expertise. The adjuster informed Mr. Nolte that his roof was in good condition. The only damage and repairs needed were to the ridge vent system, fascia, gutters and down sprouts, window screens and air conditioner vents.
However, other insurance companies paid up without issue to fix other roofs in the area. Nolte took notice and brought in two additional contractors to examine his roof. He was informed by both experts of hail damage to his roof but was still denied coverage by Erie insurance after filing an appeal.
Nolte got in touch with Schmidt Kramer about the situation. Scott Cooper, a partner at our firm, has been appointed to the case. The company was asked to reconsider and fix the roof, but to no avail, Cooper stated in an interview with FOX43 Finds Out.
A lawsuit has now been filed against Erie Insurance Group for acting in bad faith. Cooper is seeking a full roof repair for his client.
This is not the first time Erie insurance has come under scrutiny for its practices. Another report has uncovered other customers in Southern York County who were denied compensation for roof repairs.
The Pennsylvania Insurance Department received 14 complaints from Erie customers related to hail damage in 2018. After an investigation of each claim, customers were issued a letter from the Department detailing that it did not find any violations made by Erie insurance.
Erie Insurance Group continues to stand by its actions and will not comment on specific policyholder claims due to privacy laws.
